Why Twitter may be sued for changing brand identity to ‘X’ – Times of India

Elon Musk’s decision to change the brand identity of Twitter to ‘X’ may land the company into legal trouble. According to a report, companies including Facebook parent Meta and Microsoft already have intellectual property rights to the same letter.

The letter ‘X’ is widely used and cited in trademarks and the company could face its own issues defending its X brand.
“There’s a 100% chance that Twitter is going to get sued over this by somebody,” news agency Reuters quoted trademark attorney Josh Gerben, as saying. Gerben said that he counted nearly 900 active US trademark registrations that already cover the letter X, and these companies are spread across a wide range of industries.

Trademarks protect things like brand names, logos and slogans that identify sources of goods. Owners can claim infringement if any other branding uses the same name/ logo which could create confusion among consumers.
Meta, Microsoft may not sue X
He, however, said that Meta and Microsoft are likely to sue Twitter unless they feel threatened that the new brand encroaches on the brand equity they built in the letter.
Since 2003, Microsoft has owned an X trademark which it uses in communications related to the Xbox video-game system. Meta Platforms also owns a federal trademark registered in 2019 covering a blue-and-white letter “X” for fields including software and social media,” the report said.
Meanwhile, Meta also faced trademark issues in the past when it changed its brand name from Facebook. It faced trademark lawsuits by investment firm Metacapital and virtual-reality company MetaX, and settled a case over its new infinity symbol logo.
Rebranding of Twitter
Musk and the company CEO Linda Yaccarino announced that Twitter will now be known as X and they unveiled a new logo for the social media platform. Soon, the notable bird logo was changed to the letter ‘X’ on the web.
