Flipkart directed to pay Rs 45k for delivering broken device to customer in Uttarakhand | Dehradun News – Times of India
DEHRADUN: The Udham Singh Nagar district consumer disputes redressal commission has ordered e-commerce company Flipkart and a Haryana-based laptop supplier to pay Rs 45,000 as compensation to a customer who ordered a Lenovo laptop but instead received a broken and defective device of Compaq.
The commission also ordered to pay the booking amount of Rs 42,974 along with litigation fee of Rs 5,000.
The customer, Lokesh Kumar, said that he had ordered a Lenovo laptop in April 2021 with complete specifications and paid the money online. But he was “shocked to receive a Compaq laptop that was old and broken”.
“I immediately placed a replacement request through the Flipkart app and also emailed the company, but to no avail,” he added.
Flipkart’s counsel Pavael Kathayat said that since his client does not sell any product and is only a web interface that acts as an intermediary, it was wrongfully made a party. “Since the applicant is not a consumer of Flipkart, the petition against it should be dismissed,” he added.
The commission asked that “when Flipkart provides a platform to the suppliers, will it not take any action against them for cheating the customers? The customer placed an order for the laptop without knowing the supplier.”
“Besides, Flipkart does not provide a free service to the suppliers. It gets a share of the profit after the deal is done. Therefore, it is also liable for deficiency in service on the part of the supplier as well as unfair trade practices,” the court further said.
The commission ordered the compensation amount and cost of the device to be paid within 30 days of the order or the customer would be entitled to get an interest of 8% on the entire amount.
