Nokia has won the patent dispute against Vivo at the Mannheim District Court in Germany. The case relates to the Nokia 4G standard-essential patent (SEP) and, if enforced, could result in Civo being barred from the German market.
Earlier, Nokia had won legal battles against Oppo and OnePlus over the same essential patents for 4G standards, which led to a ban on the sale of Oppo and OnePlus products in Germany.
“Vivo fully respects intellectual property and is committed to continuous innovation through extensive research and development. In recent years, Vivo has entered into cross-licensing agreements with numerous leading companies. We have negotiated with Nokia about renewing the mutual licences, but, so far, have not been able to reach an agreement,” writes the company in the press release.
Vivo says that “We firmly believe that Nokia has not yet fulfilled its obligation to offer a licence on “FRAND” (fair, reasonable and non-discriminatory) terms.” SEPs are patents that companies are required to licence to comply with a technical standard, and these patents are licensed under FRAND terms. Nokia has one such SEP that Vivo needs to licence, but the latter believes it is being charged an exorbitant amount.
If necessary, Vivo will “suspend the sale and marketing of the products concerned through the official channels of Vivo Germany.” Although, for now, the products are available for purchase through official channels and third-party retailers.
The Chinese smartphone manufacturer expresses their disappointment with the German lawmakers, saying that “the company is preparing to appeal the decision and will review other options. In the meantime, we will continue negotiations with Nokia to resolve the matter in accordance with “FRAND” terms.”
