TikTok sues US state over the “unconstitutional” ban – Times of India
A lawsuit was filed by the social media app, owned by China’s ByteDance, on Monday in federal court. TikTok argues that the upcoming ban violates the First Amendment rights of the company and its users. According to the lawsuit, the ban on the app was unconstitutional as it prevented all speakers from using the platform for speech.
“We are challenging Montana’s unconstitutional TikTok ban to protect our business and the hundreds of thousands of TikTok users in Montana,” Brooke Oberwetter, a TikTok spokeswoman, said in a statement. “We believe our legal challenge will prevail based on an exceedingly strong set of precedents and facts.”
A group of TikTok users has filed a separate lawsuit claiming that the bill violates their First Amendment rights and exceeds the state’s legal authority. The law has also caused concerns among civil liberty and digital rights organisations, including the American Civil Liberties Union and the Knight First Amendment Institute at Columbia University.
Emily Flower, a spokeswoman for Montana’s attorney general, said, “We expected legal challenges and are fully prepared to defend the law that helps protect Montanans’ privacy and security.”
The bill, which comes into effect next year, aims to protect the privacy of state residents by preventing the Chinese government from accessing their personal information.
As a result, TikTok will not be allowed to operate in the state, and app stores such as Apple and Google are prohibited from making the app available for download. Daily fines of $10,000 may be imposed on TikTok, Apple, and Google for non-compliance.
There is growing concern about TikTok’s connection to China. Despite ByteDance’s denial of sharing data with the Chinese government, US officials continue to voice concerns about TikTok’s association with China.
Many US states and the federal government have already prohibited using the app on government devices. The Biden administration has also warned that it may impose a nationwide ban unless ByteDance divests its shares
